General Terms and Conditions for reservations in ZFV-Genossenschaft restaurants
1. Scope of application
These General Terms and Conditions (GTCs) govern table and group reservations between the restaurant companies of Genossenschaft ZFV-Unternehmungen and the guest/customer/event organiser made via the aleno online reservation tool or via the restaurant’s other reservation channels.
aleno is a restaurant management system provided by aleno AG, which has its registered office in Switzerland.
2. Conclusion of the contract
The contract concerning the reservation of tables, spaces and other deliveries and services is concluded upon written confirmation from the guest’s chosen restaurant or, in the case of internet bookings, when the guest confirms the booking.
A reservation made on the day of the event itself becomes binding the moment it is accepted by the restaurant.
Amendments to the contract become binding for the restaurant once confirmation of receipt is received in writing. Unilateral amendments or additions to the contract by the guest are invalid. aleno is solely the technology platform via which the reservation is transmitted and is not a party to the contract.
3. Definitions
Groups:
Within the meaning of these GTCs, groups refer to bookings with a minimum number of 15 people.
Small groups:
Within the meaning of these GTCs, small groups refer to bookings with a minimum number of 7 people.
Individual guests:
Within the meaning of these GTCs, individual guests refer to bookings with 1 to 6 people.
4. Scope of service
A reservation entails a reservation for a table at the chosen or confirmed restaurant for the specified number of people and at the chosen time.
The guest has no entitlement to a specific table/room unless another contractual agreement specifies otherwise.
The duration of use for a reserved table is limited to the following time window:
· For afternoon reservations: 90 minutes
· For evening reservations: 120 minutes
These respective windows commence from the chosen time.
In the case of groups, the restaurant reserves the right to set a standardised, pre-defined offer (e.g. menu). Generally speaking, there will be the option to make choices within the scope of this offer (in particular regarding meat or vegetarian cuisine).
5. Conditions of cancellation
If a reservation is to be cancelled, the restaurant must be given as much notice as possible. The restaurant will confirm the cancellation in writing.
If a reservation is cancelled or if guests fail to appear at a reservation, the following cancellation fees shall become payable:
· If a reservation is cancelled within the notice periods specified below, a fee of CHF 50.00 shall be charged per person:
· Individual guests: less than eighthours before the start of the reservation window
· Small groups: less than eight hours before the start of the reservation window
· Groups: less than 24 hours before the start of the reservation window
· If guests ignore or fail to appear at a reservation (no-show):
· Individual guests and small groups: CHF 50.00 per person
· Groups: 80% of the costs based on the advance orders placed per person
The cancellation fees are also charged if only some of the people booked in for the reservation fail to appear or cancel.
The restaurant reserves the right to amend the cancellation conditions on a case-by-case basis depending on the nature and size of the event and to integrate the amended conditions into the booking/order confirmation.
When calculating the cancellation fee to be paid, the decisive factor is the time when the restaurant receives the guest’s cancellation via the aleno reservation platform or, in the case of cancellation by phone, when the restaurant confirms the cancellation.
In the aleno reservation tool, credit card details are stored as security for the cancellation fees. The credit card details serve the sole purpose of debiting any cancellation fees owed.
To ensure that any cancellation fees can be debited, the restaurant is entitled to check whether the credit card stored on file is valid and has sufficient balance. If authorisation or pre-authorisation is unsuccessful, the restaurant is entitled to cancel the reservation at any time.
The requested credit card details must be saved within six hours of the reservation being made or the reservation will be cancelled.
6. Children
Children aged 12 and up count as individual people and must be included in the number of people under a reservation.
7. Food and drink
All food and drink must be purchased from the restaurant only. In special cases, an agreement may be made to the contrary. In such cases, the restaurant is entitled to request a service fee or corkage/forkage.
8. Dogs
Dogs may only be brought with the restaurant’s agreement and their behaviour must be properly controlled and supervised for the entire duration of the visit. They must be kept on the floor at all times; seating them on chairs, benches or tables is not permitted.
9. Liability
Any liability on the part of the restaurant arising from this reservation contract is excluded.
The guest is liable vis-à-vis the restaurant for any damage caused by them, their companions, assistants or event attendees, without the restaurant having to prove that the guest is at fault.
If a third party has made the booking in their own name on behalf of the actual guest, the third party shall be a joint and several debtor vis-à-vis the restaurant for all obligations arising from the contract.
The guest is also liable for costs incurred by the restaurant as a result of payments to third parties.
10. Data protection
10.1. Recording of guest data for reservations
In the course of using aleno as the reservation platform, the restaurant records personal data about guests (“Guest Data”). Guest Data is made up of the following data:
· First name and surname
· Phone number and e-mail address
· Number of people, time and date of the requested visit
· Postcode
· Residential address (optional)
· Company (optional)
· Information about allergies and intolerances (optional)
Recording Guest Data enables the restaurant to process the reservation request and to ensure that the table wanted by the guest is reserved in their name and that, if necessary, the restaurant can contact the guest.
The Guest Data recorded by the restaurant is not automatically deleted after the reservation has been made, but is used instead to create a personal guest profile.
The guest has the right to request the deletion of their Guest Data at any time. If the data is deleted prior to the date of the reservation, the relevant reservation will be automatically cancelled.
10.2. Recording of credit card details for reservations
In the course of saving a credit card on file as security for payment purposes, the following details (“Payment Details”) are collected:
· Name of the credit card issuer
· Name of the credit card holder
· Credit card expiry date
· Credit card number and security code
All Payment Details are automatically anonymised. This means that the Payment Details do not constitute personal data within the meaning of the Federal Act on Data Protection (FADP). The Payment Details are also transmitted directly to aleno’s hosting provider. The restaurant has no access to the anonymised Payment Details and does not save them on its own system either.
10.3. Responsibility and further information
The restaurant uses aleno as a data processor for the processing of Guest Data, Payment Details and guest profile data and has concluded a data processing agreement with aleno. The restaurant bears responsibility towards the guest for processing their data correctly and is the guest’s point of contact for exercising their rights arising from the Federal Act on Data Protection (FADP).
11. Final provisions
In addition to these GTCs, further provisions and reservation conditions may apply which supersede these GTCs, if these have been agreed between the restaurant and the guest. Genossenschaft ZFV-Unternehmungen reserves the right to amend the GTCs at any time without citing a reason. Such amendments do not apply to reservations that have already been booked.
Swiss law applies. The exclusive place of jurisdiction is Zurich.
Should individual provisions of these GTCs be or become ineffective, this shall not affect the validity of the remaining provisions.
